1. Service provider
Wiltan Digital is a web design and maintenance service operated by Emilio Williams. Contracts are concluded and invoices are issued through the business incubator Fundacja Firma Dla Każdego, ul. Lwowska 17/4, 00-660 Warszawa, Poland — NIP: 5252625624 · KRS: 0000569410 · REGON: 362170026 — registered as an active VAT taxpayer in Poland, acting as the legal contracting entity. 2. Services and service model
Wiltan Digital designs, builds and maintains websites under a Website-as-a-Service model: a one-time setup fee covers the design and build of the website, and a monthly fee covers hosting, domain management, software updates, backups, security monitoring and keeping the site online. The website remains functional while the monthly plan is active.
3. Quotes and prices
Prices shown on this website are indicative starting points in EUR and may vary depending on the scope of each project. Every project begins with a written quote stating a fixed price and scope. Only the written quote is binding. Prices for business clients are stated net of VAT; applicable VAT is added according to EU rules based on the client's country and VAT status.
4. Payment terms
- Setup fee: 50% before work begins and 50% upon delivery of the functional website.
- Monthly fee: payable in advance, starting after any free period included in the chosen plan.
- Invoices are issued by Fundacja Firma Dla Każdego and payment to it constitutes valid payment for the services.
5. Client cooperation and revisions
The setup fee includes up to two rounds of revisions on the proposed design and structure. Additional changes are quoted separately. The client agrees to provide the materials and feedback needed for the project within a reasonable time. If the client remains unresponsive for 30 consecutive days after a formal request, the project may be considered abandoned; in that case the first 50% payment is retained to cover work performed and reserved capacity, and the project files are kept for 100 further days before deletion.
6. Late payment of the monthly fee
- After 31 days of non-payment, the website may be taken offline and the licence suspended.
- After 60 days, Wiltan Digital is released from responsibility for the domain name, which may expire or become available to third parties.
- After 100 days, the contract is considered terminated for non-payment and the site may be removed from active servers. Reactivation, where technically possible, requires payment of outstanding amounts plus a reactivation fee stated at that time.
7. Intellectual property and licence
The hosting environment, templates, integrations and code created by Wiltan Digital remain its property. The monthly fee grants the client a non-exclusive, non-transferable licence to use the website while the plan is active. Content supplied by the client (texts, images, product data) remains the client's property. Open-source components included in the website carry the rights granted by their respective licences. Upon termination with payments up to date, the client receives their content (texts, images, product lists and captured form data) and the domain is transferred to a registrar of their choice.
8. Cancellation and termination
- The client may cancel the monthly plan at any time with two weeks' notice before the next billing date. No partial refunds are made for unused periods.
- Wiltan Digital may terminate the service with 90 days' notice, delivering a backup of the client's content and the credentials needed for migration.
- Consumers within the EU have a 14-day right of withdrawal from distance contracts; by requesting that work begin during this period, the consumer acknowledges that the right of withdrawal is lost once the service has been fully performed, and that early withdrawal may be charged proportionally to work completed.
9. Liability
Except in cases of intent or gross negligence, liability is excluded for indirect damages, loss of profit or loss of business, and for failures caused by circumstances outside Wiltan Digital's direct technical control, including third-party attacks, failures of external APIs and payment gateways, hosting infrastructure outages, or automatic updates of third-party software causing incompatibilities. In such cases reasonable efforts will be made to diagnose and restore the website. Total liability for proven contractual claims is limited to the equivalent of twelve monthly fees paid by the client, or, for e-commerce projects, the higher of twelve monthly fees or the setup fee paid. Nothing in these terms limits rights that consumers hold under mandatory law in their country of residence.
10. Third-party services
Websites may integrate third-party services such as payment gateways, booking tools or automated chat assistants. Wiltan Digital does not guarantee the availability or performance of third-party services and is not a party to the client's relationship with those providers. Clients operating websites that collect personal data from their own users are responsible for their own privacy policy and legal texts; Wiltan Digital provides only the technical placement of such texts.
11. Governing law and disputes
These terms are governed by Polish law. Disputes will be submitted to the competent courts of Warsaw, Poland. Consumers may also rely on the mandatory consumer protection rules and courts of their EU country of residence, and may use the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
12. Changes to these terms
These terms may be updated; the current version with its date is always published on this page. For ongoing monthly services, material changes will be notified at least 30 days in advance, and clients who disagree may cancel without penalty before the changes take effect.
